Terms of Service
for the provision of services to Housing Seekers (the "Terms")
1. About RemoteStay
1.1 The Platform is an online marketplace operated by RemoteStay LLC, enabling owners or managers of fully furnished residential units ("Housing Providers") to list such units ("Properties") and offer them for short- to long-term lease to prospective tenants ("Housing Seekers"). The Platform displays essential information about each Property (e.g., photographs, description, rent, sample lease wording) and facilitates communication and contract formation between Housing Provider and Housing Seeker.
1.2 Housing Seekers must supply accurate, current and complete information. By creating an account, the Housing Seeker consents to the Operator's processing of personal data. Supplying false information constitutes a serious breach that may render a Lease Agreement void and expose the Housing Seeker to damages. The Operator may review content, cancel reservations and deactivate accounts that violate these Terms.
1.3 The Operator acts solely as an intermediary. Lease Agreements are executed directly between Housing Seekers and Housing Providers. Rent and related fees are paid through the Platform by cashless transfer or payment card.
1.4 All costs arising from the Lease Agreement are borne by the contracting parties. Where refunds are due under a Lease Agreement, settlement is made directly between Housing Seeker and Housing Provider without the Operator's participation.
1.5 The Operator is not responsible for any direct or indirect loss experienced by a Housing Seeker arising from occupation of a Property. The Housing Seeker is liable to the Housing Provider for any damage caused during the tenancy.
2. Lease Agreement Process
2.1 Properties are delivered fully furnished and utility charges (water, electricity, gas, internet) are included in the rent up to 15% of the agreed rent. A Housing Seeker wishing to rent a Property submits a reservation request (“Reservation”) via the Platform.
2.2 Housing Providers have 24 hours to accept a Reservation (extendable once by a further 24 hours at the Housing Seeker's request). Any alteration to the listed inventory after the Reservation is received requires the Housing Seeker's consent.
2.3 Housing Providers may decline any Reservation without stating a reason.
2.4 Acceptance of a Reservation constitutes the Housing Provider's offer to enter into a lease on the terms published in the listing. The maximum occupancy stated in the Reservation is binding.
2.5 Upon acceptance, a 24-hour cooling-off period begins in favour of the Housing Seeker for concluding the Lease Agreement.
2.6 The Lease Agreement is deemed concluded when:
- (a) the Housing Seeker completes the required information
- (b) approves the draft lease in the Platform
- (c) confirms via the one-time code sent by the Operator
The Housing Seeker must then upload a copy of a valid ID; the Housing Provider must ensure the lease data matches the ID.
2.7 The Housing Seeker must pay, within 24 hours (or 3 hours if move-in is less than 24 hours away), the Platform service fee, first rent instalment and any deposit (“Initial Payment”). The Lease Agreement enters into force once payment is made. The Housing Provider may not offer the Property to others within the first 24 hours of acceptance.
2.8 Failure to pay the Initial Payment on time voids the Lease Agreement. If payment is received late and the Housing Provider does not cancel within 24 hours thereafter, the lease becomes effective.
2.9 Prior to the move-in date, the Housing Seeker may terminate the lease by written notice. Refunds follow the cancellation policy shown in the listing; the remainder of the Initial Payment is retained as compensation to the Housing Provider.
2.10 The Housing Provider may cancel the lease at any time before handover; the Initial Payment is refunded in full to the Housing Seeker.
2.11 After move-in, early termination by the Housing Seeker does not entitle them to a refund of the service fee. Early termination by the Housing Provider entitles the Housing Seeker to a proportional credit against a future service fee.
2.12 The Operator may offset its claims against any claim of the Housing Seeker. Transfer fees and currency conversion costs are borne by the payer.
2.13 Housing Providers may request a security deposit if required by law or, where not required, for leases of 180 days or more. The deposit must be repaid by bank transfer within 7 days after the lease ends, minus damages or outstanding charges.
2.14 House Rules and a handover protocol form part of the Lease Agreement and must be supplied by the Housing Provider.
3. Rights of Housing Seekers
3.1 The Housing Seeker may withdraw from the lease until 20:00 on the day after handover if the Property materially differs from the listing and the issue cannot be remedied immediately. Withdrawal is not permitted where:
- (a) the Property is the same as listed
- (b) a hygienic/functional deficiency is corrected within 48 hours or a rent reduction is agreed
3.2 If the Housing Seeker withdraws under 3.1 or the Housing Provider fails to provide the Property, the Housing Seeker is entitled to:
- (a) reimbursement of comparable accommodation for up to 7 days (daily price +25%)
- (b) Operator assistance in locating replacement accommodation
- (c) refund of the service fee
Claims are paid retrospectively on submission of receipts within 14 days.
4. Final Provisions
4.1 Should any provision be invalid or unenforceable, it shall be replaced by a valid provision that best reflects the original intent. The validity of remaining provisions is unaffected.
4.2 Property listings are based on data supplied by Housing Providers. The Operator is not liable for errors or omissions but provides a guarantee as set out in these Terms.
4.3 The lease forms solely a contractual relationship between Housing Provider and Housing Seeker; the Operator bears no liability for any breach by either party.
4.4 Users may rate one another via the Platform; ratings are visible to the Operator and other users.
4.5 The Operator may market listings through third-party channels and publish reviews and photographs uploaded by Housing Seekers.
4.6 These Terms are governed by the law of Tel Aviv, Israel. Consumers may bring proceedings in their place of residence or the Operator's domicile. Non-consumer disputes are subject to exclusive jurisdiction of the courts of Tel Aviv, Israel.
4.7 Housing Providers are solely responsible for complying with all applicable laws and regulations and for lawful handling of personal data.
4.8 The website and services are provided “as is” without warranties. Except where prohibited by law, the Operator disclaims all implied warranties of title, merchantability, fitness for purpose and non-infringement and accepts no liability for errors, delays, service interruptions or user conduct.
4.9 Where the Housing Provider and Housing Seeker are businesses, the Operator, its affiliates, officers and employees shall not be liable for:
- (i) lost profit, data, business, savings, goodwill or opportunities
- (ii) indirect or consequential loss
4.10 Where the Housing Provider or Housing Seeker is a consumer, the Operator is liable only for foreseeable loss resulting from its breach of these Terms or negligence. The Operator is not liable for unforeseeable loss or for business-related loss.
4.11 If any limitation of liability is held unenforceable, liability shall be capped to the maximum extent permitted by law.
4.12 Non-local language versions of these Terms are provided for convenience only; the local version prevails in case of conflict.
4.13 On registration, users request the Operator's intermediation services. The service fee is non-refundable once those services have been provided.
4.14 The Operator may amend these Terms. Users will be notified by email and may reject the changes within 10 days.
